Define Culture Essay

â€Å"A person without the knowledge of their past history, origin and culture is like a tree without roots.†- Marcus Garvey. This says that a person is defined by his or her culture by the way he/she acts, thinks, and speaks. A person is defined by his or her culture by the way he or she thinks. A person see’s the world differently so the way they think and act would be distinct. They would think differently because of the different backgrounds that they have. In the story â€Å"Imagine†, it says â€Å"you may say I’m a dreamer, but I’m not the only one. I hope someday you’ll join us and the world will live as one†. John Lennon explains how people think he’s different because of what he is. He also says how people aren’t all the same but he wishes that one day we were. He wishes that one day we will all see the world the same and we would be the same. A person is defined by his or her culture by the way he or she’ s history, family tree, and he or she’s way of life. A person is defined by his or her culture because it effects the way they act or speak. In the story â€Å"Where I’m From,† George States â€Å"†¦leaf fall from the family tree†¦Ã¢â‚¬  This example from the text explains that every detail, moment, or where she is from in the poem is from her family tree. It’s saying the poem are moments or cultural things that effected her or shaped her as a person. The things she shares in the poem are all from her families history or culture (family tree). Although others may argue that culture doesn’t effect your education, other people don’t always agree,because their culture has taught them everything they know.An example on how culture defines your education is that people can attend any school , but when they are being taught, they realize that it is different from what they know. In the story, â€Å"An Indian Father’s Plea,† the protagonist argues, â€Å"My son is culturally â€Å"different.† If you ask him how many months are in a year he will probably tell you 13. He will respond this way not because he doesn’t know how to count but because he was taught by our people that there are 13 full moons in a year.† This quote demonstrates that even though he is Indian, he is culturally different because his culture has taught him what he knows. Your families history, education, and your view or the way you think all contribute on how your culture defines you. It’s obvious that any person would benefit from he or she’s culture.

Influence of Western European Economy on Migration Since 1945 Essay

After the end of the second world war, many European countries suffered from the effects of the war and the future of the continent was in doubt. Most countries had a hard time rebuilding and recuperating their economies from the aftershocks of the war. The western part of Europe, after a torrid time of economic and political hardship, began to recover and rebuild their countries. In the years that came after the war, the countries in the western region had to enact cooperative measures with each other as opposed to competing with each other to ensure that they survived the torrid period together. This period was marked by complex processes with the rolling out economic programs that would reduce trade barriers among the countries and this kick started a period of significant economic development in the region. The migration history of Europe represents an unplanned development and unintended occurrence. It represented a combination of labor migrants, colonial migrants and asylum see kers (Schönwälder, 2003). This essay will establish the link between successful economic periods in western Europe and the levels of migration into these areas. The postwar migration can be categorized into two phases; a regime which involved colonial migration and that which involved the migration of guest workers. Those migrated came to look for work opportunities which were created by the ten recovering and booming economies in Western Europe. In the 1970’s, there was an interaction of economic deficiencies with colonial migration before the war. This also interacted with the existing citizenship regulations in countries such as France, Belgium, UK and the Netherlands while countries such as Austria , Denmark, Germany Sweden and Switzerland had implemented guest-workers policies that were a major attraction for foreign migrants. Germany enacted a currency reform in 1948 which instigated the recovery of its economy. In mid 1950’s, the country along with the others in the western region of Europe experienced high labor demand levels that could not be satisfied locally. A unanimous pattern in Western Europe at that time involve d sourcing of labor from the eastern parts of Europe as they believed that migrants from those parts could be integrated easily into their systems. This expanded into the northern countries in Africa and countries near the periphery of middle east such as Turkey. The countries arranged guest-worker schemes among themselves and other interested countries out of their region. Trade unions especially in Germany saw the guest-worker programs as a threat to existing wage rates as they feared that they would experience a downward spiral at the end. Governments in Western Europe particularly Germany’s incorporated measures that ensured that the guest workers enjoyed the equal work conditions as their European counterparts. The basic principle behind the scheme of guest-workers was that that the foreign workers would remain in the countries as long as they held their jobs and would leave back to their native countries once the economy started to perform badly. In Germany for example, many guests-workers left the country during the 1968 economic recession with the guarantee that they could return when the economy recovered and the labor demand went up again. In the early 1970’s, the huge numbers of migrant workers in the European market were causing an economic slowdown and most of the countries responded to this by stopping the migration programs in 1973. This, however did not result into the intended result of migrants moving back to their countries. Many guests-workers remained in the countries where they received help from NGOs and charitable organizations in addition to favorable court judgements which permitted their stay. This case was most prevalent in Germany. Countries such as France, Sweden, Austria, Belgium, Switzerland and Holland implemented varying forms of the guest-workers policies which sharply decreased the extent of migration related to labor from 1973 onwards. In the other regime of labor migration touching on colonial background, bilateral and multilateral agreements in regard to guest-workers became the sole supply of migrant labor. UK, Netherlands, France and Belgium had the capability of drawing huge numbers of unskilled laborers. Policymakers were thought to have tapped at the opportunity colonial labor offered to satisfy the boom experienced after the war but this was not the case. The inability to secure domestic workers meant that the policymakers had to rely on colonial migrants to feed the labor demand. This was mostly practiced in France and UK with limited implementation in Belgium and the Netherlands (Schönwälder, 2003). In the postwar period, UK put into trial its version of the migrant worker scheme by sourcing workers from the Eastern part of Europe. However, the local economy became sluggish and this reduced the pull factor that UK had on migrant workers. Countries such as Germany, France, Austria and Switzerland were more appealing and attractive to migrant workers from eastern Europe countries. The UK economy was not on the same level with the rest of western Europe but its situation with guest-workers were enhanced by its citizenship program which integrated over half a billion colonial subjects into the country’s fold. In 1948, UK had in place legislation that confirmed all of its former colonial subjects as the country’s citizens with rights to enter and enjoy all social, economic and political rights within the country. The resulting occurrence was the inflow of migrants of Indian and Pakistan origin in the country. The economy of the country enjoyed a full employment rate at the time and there were labor shortages which the migrants helped to correct. By 1962, UK had over half a million non-white colonial migrants and this marked the start of restrictive measures that regulated the inflow of colonial migrants. The figure of non-white colonial migrants had risen to over a million by 1972, a period which saw UK cut on the privileges associated with UK nationality status at the time (Strayer, 2009). France on the other hand concentrated on migrants from northern Africa particularly from Algeria though not a former French colony. The supply of the labor migrants was hampered by completion from Germany and Switzerland which were experiencing increased economic growth. This shortened the supply of labor in France and the interest of the European nations in colonial labor resulted to an increased migration of Algerians into the country as they had the right to enter France, a case similar to that of UK. French companies sourcing for cheap labor looked to Algeria, Tunisia and Morocco as credible sources of such labor. The system was tighter in Austria, Germany and Switzerland but the French took the opportunity to directly hire colonial migrants into their companies and confirm their nationality status afterwards through the National Immigration Office (Foley, 1998). In recent decades from the 1980’s, the largest percentage of migrants into Europe have come from West Africa. This has been accentuated by extreme poverty levels, high rates of unemployment and political instability in some of the nations. This has been enhanced by the perception held by many people that Africa is a continent plagued by miseries of all kinds. Despite these challenges afflicting people in Africa, the promise of a better life and economic conditions in the dominant Western Europe countries offers a unique attraction to African migrants into the economically developed countries. The European economy is a major contributor to the success of the global economy and presents numerous lucrative and medium scale job opportunities for skilled, semi-skilled and unskilled laborers from all walks of life. The prevailing excellent economic conditions act as the main pull factors for migration into the more popular countries in Europe such as Germany, France and UK. These co untries offer a chance for many migrants who are driven by the sheer aspiration to live in a western country. After many African countries gained independence, the education systems were hugely improved and this resulted into the outlet of highly learned and qualified personnel . The demand for expatriates and skilled labor in the Western European economy presented a great chance for the ;learned people to move abroad and try their luck with corporate and technological jobs. Most colonial powers had projects that flew talented students in their countries to present better academic opportunities for Africans. In the current era, a significant number of migrants in the Western part of Europe are students who come to achieve advanced educational dreams. The European countries are well economically developed which translates into quality education structures which are among the best in the world. Many students of African, Indian and Asian descent migrate to these countries to tap into t he great educational opportunities that are present in these countries (Schönwälder, 2003). Migration patterns are created through network functionality. Which leads to the rise of migration systems that act as links to origin and destination countries through an established exchange of products, people, information and capital remittances. The systems may be legal or informal but all contribute to the continous cycle of family and labor migration . Currently,many countries in Western Europe pay more attention to migration of skilled laborers who are viewed as capable of bettering their economic growth. The UK and Germany have taken significant steps towards this priority by issuing work permits to the highly-skilled labor migrants. This attracts many professionals who believe they have a great chance of succeeding in those countries. In 2000, Germany introduced a ‘green card’ program aimed at attracting over 20000 highly qualified workers. This was in pursuit of further economic progress, a factor that acted well in raising the migration levels in the country and therefore into Europe. In a period spanning from 1999 to 2004, France has seen the number of foreign migrant rise from 376000 to more than 570000 which signifies a rise of 35000 migrants annually. These migrants were mostly of African descent who came to France for educational. Job and resettlement purposes. In recent years dating from the 1970’s into the new millennium some African countries have suffered from political instabilities which have resulted into civil unrests in those countries. The civil unrest acted as the push factor which caused many migrants to leave their war stricken countries. However, the choice of their destination country was mainly influenced by , the economic stability of that country. Many western European countries presented this option and represent viable choices where the migrants can be granted asylum and thrive under better humanitarian conditions as opposed to neighboring countries. The migrants go against all odds to reach the European mainland with the hope that once they are there, they will find ways of integrating i nto the local population and tap into the available opportunities of work and settlement. In the 1980’s, asylum applications had reached 320000 and more than doubled from 1992 in Germany. In Britain the numbers hit the 100000 mark. Most of these migrants are offered refugee status but their main aim of coming to these countries is to find a better a life away from their native countries. This notion is enhanced by the high economic performance levels identified with the European economy(Strayer, 2009). In the European region, specifically the western part offers the second largest intra-regional migration of workforce behind America. Most of the migrants in this region have been attracted to this place by the prospect of successful lives in countries and regions experiencing economic booms. However, the uncontrolled number of illegal migrants poses a challenge to them and the same economy that attracted them to these countries. Most of these migrants are mostly concentrated in low-skill tertiary sectors of the various industries present in the region. With the recent economic crisis in the world and in the European region, most of the migrants were faced with various vulnerabilities associated with economic pressure as they depended on unsustainable resources and their status as migrants only made matters worse for them. In light of the economic problems that afflicted the region in 2008,. The countries in the region in conjunction the whole EU body started to enact immigration pol icies that would control the levels of migration during the hard economic conditions. These policies were proposed and enacted to shield the labor sector from increased worsening conditions and to protect the existing wage rates which had a significant effect of the economic downturn at the time (Kaelble, 2011). In conclusion, it is clearly evident that many push and pull factors that have influenced migration into Western Europe. However, the economic success that the region has enjoyed in the years after the second world war in the current era of economic recessions and recoveries acted as a major influence in determining which part the migrants moved to. The economic conditions in this region provided numerous opportunities for the migrants to progress their lives and mould a successful future. With the demand for labor souring in the region at one time and the advent of excessive inflow of migrants through various economic periods shaped by both success and downturns, the main pull for migrants to the western part of Europe was the economic development that Europe was identified with. There are societal issues that affect only the a specific gender therefore for the government to be able to make relevant legislations and provisions it is important that the issue at hand is uplifted and therefore observed in a positive light. The first book I selected was The Adventures of Tom Sawyer by Twain, Mark. This novel is about a mischievous and very adventurous boy called Tom Sawyer, who was living along the Mississippi River, in the St. Petersburg, Missouri (Twain, 1990). Tom is an ill-behaved boy, who engages in fights at school, consequently dirtying his clothes and arriving home a total mess. As a punishment for his misbehavior, he is required to whitewash a fence, which he is apparently not willing to do. Therefore, he applies his cunningness to trick his friend into doing it, with a promise of granting him some treasure in form of tickets to a Bible memorizing contest, where one would end up with a Bible as a prize. Despite being cunning and lazy, Tom is also immora l and dishonest. He happens to fall in love with a new girl who had recently arrived in town, Becky Thatcher, and asks her to kiss him, as a sign of engagement. Analysis Of A Prayer For Owen Meany English Literature Essay The economical/political social background of the story A Prayer for Owen Meany by John Irving had a huge impact on the characters and the plot of the story. John Irving  chose to write about Americas political state throughout the story to connect it to past tragic events which have occurred in the main characters life. His writing style makes us aware of his view on Americas society and he too, like the main character in this book moved from America to Canada. Owen Meany claimed himself to be the instrument of God. His parents told him he was a virgin death; could he be the baby Christ? John Irving presented Owen with characteristics which made him seem like he is not part of this world. Owen could have been a tragic hero.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Many unpleasant events occurred throughout Owens life even though he was a virtuous person. He died by saving the life of Vietnamese kids. This connects to Romeo and Juliet, because when they died, their death made the Capulets and Montagues stop the feud and it made them notice how it was stupid of them to keep the two apart and they started to settle their differences. Before Owen died, his family would hate the Catholics for an event which occurred in their families past history. However, Owen died helping a nun take children to the washroom and so everyone realized their hate for each other was nonsensical. The major knew Owen had been a hero (616). A tragic hero always has a huge impact on the characters and readers, and Owen changed everyones opinion about who he truly was. I guess we were wrong about your little friend (556). Owen motivated the rev to find his lost faith and now he spoke with belief and confidence at the funeral. Ow en was not just a hero to the United States Army- he was our hero (556). There was something about him that attracted everyone. Even Johns mother loved Owen just like her own son. Owen would never complain about others and he would just stay there and take in the pain which symbolized him as a martyr. When he saw a man on the streets, he would want to help him right away. WE SHOULD STOP AND HELP THAT MAN (25). He had qualities which most of us humans dont possess no matter how noble and devoted we are. He even played the baby Christ in a play and that compared him to one of Gods messengers. He would follow the holy book and always asked: Does it say so in the bible? (170). Owens strange small size and very high voice was a symbol as well. This demonstrated to us how he was not a normal human but something different. Owen never tried to change his voice, because he knew it was for a purpose and it came from God. He was represented as a leader. He also  controlled people older than him and he even demanded the Catholics  to sign petitions against themselves. He was not intimidated by the bigger boys because he had been smaller (228). Everyone would listen to him such as the priests and he corrected them about their philosophy. Owen played the Lord Jesus in another play which showed his connection to God.   Owen was even known as the voice, because he represented everyones opinions and beliefs in the high school. Owen was exceptional, and all his differences portrayed him as Gods instrument. He didnt die unexpectedly without ever knowing. But since the day he was born, he knew his whole life ahead of him and he knew that  everything which happened to him was planned to happen, even his death. Therefore, he is related to a tragic hero because it was written in his destiny from the start. One important message the author tried to convey throughout the book was how strong the friendship between Owen and John was. Owen was the reason John got far in life and the author used many symbols and motifs to express it. After Johns mother died, Owen took her dressmakers dummy from John. DONT STARE AT THE DUMMY. ITS NOT GOOD FOR YOU (183). Owen knew the dummy would remind him of Tabitha. Not just did Owen take the dummy, but he took the baseball. The baseball symbolized the instrument of his mothers death. He also took Johns Armadillo which Dan had given to him, but he returned it after removing the claws. Without the claws, the armadillo could not be stable. All these items he took away from Owen were a motif throughout the book which represented how they both had lost something important, which they loved. In the beginning of the book, they mention Watahantowet who was an armless Indian Sagamore who owned land but lost it. This was also a reoccurring motif in the novel represe nting how they had less power and they were helpless. It even showed the pain caused by events which occurred in their life. At the end, Owen cut off Johns index finger to help John avoid joining the Vietnamese war. This shows us how John trusted Owen and placed confidence in him by knowing he had done the right thing. It seems as if Owen took a lot from John through his life. But, these examples showed us how he helped him and gave him more then what he took away. When Owen took the dressmakers dummy, John took Owens baseball cards which he loved. This conveyed how Owen wanted to communicate the feeling of loosing something important. Even at the end of the story, Owen died with his arm being blasted off. Once again, another motif of amputation of body parts represented pain and loss due to tragic incidents which occurred. When Tabitha passed away, to John and Owen, it was just like them losing an arm or breaking a leg. But to Owen, it also symbolized how he was gods instrument and his hands were being controlled by him. Owen tried to guide John. He repeated ninth grade for him and went to the same university as John and refused the offer to Harvard. John would always say: I learned it from you (502). This also creates a balance act, because on one side would be Johns most prized possessions and his only memory of his mother taken away from him. But on the other side would be the loss Owen went through for John such as living away from his parents and the meaning behind everything he took from John. Owen was a loyal and brave hero to John. He helped alleviate the losses in Johns life. In the story A Prayer for Owen Meany, the author John Irving conveys different messages. Many of the themes are connected to spirituality and portray life lessons you should follow. One important theme is based on fate, which is the belief  of the idea that your destiny is controlled by a certain force or power.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   One of the messages communicated is how everything happens for a reason, and the author shows us how strong the power of  fate is. In the novel, everything which occurred in Owens life was no coincidence. Owen believed that coincidence was a stupid, shallow refuge sought by stupid shallow people who were unable to accept the fact that their lives were shaped by a terrifying and awesome design (186). Within the previous quote, there is a metaphor which gives you an idea about how coincidences throughout your life arent arbitrary, but everything is written in your destiny and its as if your life is planned out. One example which supports that metaphor is the time during Johns mothers wedding. There was a huge storm and the author used pathetic fallacy to connect it to a horrible incident which was about to occur. It was very windy and  rainy; and Johns mother was hit by a hailstone on her head. This was a sign foreshadowing another upcom ing incident which would occur with her. When Owen was in bed feeling sick, he was walking to Tabithas room for comfort and it seemed as if he saw an angel. SOMEONE STRANGE IS IN HER ROOM. COME SEE! I THINK ITS AN ANGEL (79). This linked to another future event. It foreshadowed how Tabitha was going to die soon, because an angel of death represents taking away the soul. During Owens baseball games, he was never allowed to play. But once his coach let him get on the field, however he could never swing a pitch. As he was about to hit the ball, Johns mother was walking by. Ironically, Owen swung the bat with a good deal of force that the ball hit his mother and killed her. Owen believed that he saw the angel of death the night before, and stopped it from accomplishing its task for God. Since it was time for his mother to die, he had to finish  the task. Another tragic event which occurred in Owens life was the day he was playing football with John. He kicked the ball very far and the ir neighbours dog, Sagamore, ran after it. As Sagamore ran, he ran into a diaper truck and sadly died. The significance of this event  was a message from God demonstrating to Owen how he is the instrument of God, and he is controlled by Him. He is now given the power from God, and it motivates him in the future. Once, Owen was asked to play the ghost of the future in the play A Christmas Carol. No one knew why he was given that role and it only had a few lines which Owen disliked. But, as he was reading a name on a grave during his performance, he saw his own name and a date. IT WAS MY REAL NAME. IT SAID THE WHOLE THING. (254). The name revealed to him that he was going to be the ghost of the future and it gave away when his death would occur. Later, Owen had a dream. It was not just a nightmare, but it symbolized how God wanted him to accomplish an important task before he died. God  gave him instructions to his next task. I TRUST THAT GOD WILL HELP ME BECAUSE WHAT IM SUPPOSED TO DO LOOKS VERY HARD (400). The reason Owen was given that specific role to play was another way God wanted to show him how his death should occur. Throughout the novel, Johns mother would never tell him who his real father was. He never knew, until Owen died. Owen revealed to John who his real father was, in his afterlife. This shows us the reason why his mother never told him, because there was another way God wanted him to discover the truth. The way Owen was born had a special purpose to it too. His parents said that he was a virgin birth and therefore they disgraced Catholics.  As a result,  that created a feud. No one knew why he was born that way. Nevertheless, he was born unique and he served a purpose in life by helping so many people. Owen believed that there was a purpose to everything that happened-that god meant for the story of his life to have some meaning to it and god picked Owen(540). One motif in the book was Owen and John practising their basket-ball shot ov er and over again. They would try to break their record of scoring in 2 seconds. Later, they used this skill in an important part of the novel.   When the grenade was thrown at John, he caught it the same way Owen and him practised and they passed it to each other to stop it from exploding. Therefore, many disasters and tragic events occur in our lives and sometimes we dont deserve it. However, not only till the end do you receive the desired results you wanted from your hard work in life. Our life is like a pattern and we cannot control some circumstances,  however there is a reason for why they occur. The author had a way of communicating ideas which kept the book realistic but interesting. John Irving used various types of literary elements to convey his thoughts. The form he wrote in created a mood and tone which connected you to his characters. Owen had dreams which revealed his future tasks God wanted him to accomplish. He then went through many struggles to complete them for God. His dreams related to different stories of messengers of God written in holy books. One example is Abraham, and how he was told to sacrifice his son in his dream. This is related to Owens connection to God and how Owen isnt just a normal human. Another example in the book was how Owen had to cut off Johns index finger. This revealed how he gave the sacrifice by risking a chance of hurting his friend for God. Owen was also born a virgin birth and that is why he wasnt close with his parents due to the fact they told him this news when he was 10! But, he was born highly intelligent and even his physical looks were unique. Jesus was also born the same way with special abilities. This showed us an example of how the author brought in different ideas and fit them into the book to relate the characters to important figures and he used many allusions. Th e author also used many symbols, such as the armadillo, baseball and red dress which created examples of motifs throughout the book, which I have mentioned in the previous journals. John Irving wrote the story effectively and this caused the readers to become attached to the character of Owen Meany. The setting of the story which was during the early 1950s effects decisions the characters made. Johns mother decided to get a television when Owen was fifteen and this created an excitement. The television taught them more about the society rather than what they had seen. At that time, Christianity was also very important in the culture. However, as years went by, more immigrants started to settle in and the result was the loss of Americas identity. That is why this book is based around the theme of religion and many religious ceremonies occurred. Everyone believed in miracles and their life was dependent on faith. The author added a believable effect to the story by giving the characte rs realistic traits. Even though Owen Meany was Gods instrument and could be compared to a deferential and intelligent angel, he changed a lot. As he grew older, the people he grew up with changed him and he did start to smoke like most teenagers. As John and Owen matured, their feelings for Hester developed strongly. The thoughts through their minds would be of what males experience of the general public today. Owen was not completely pure, but he was a character which most of us would try to be like and he if we too did know him, he would have influenced us greatly. The author did not write chronologically, but put different pieces together of Johns life which revealed to us secrets throughout the end of the book. There was a thorough plot development in the book but sometimes the author dragged it on and you would want him to get to the point. It was a well written novel with many different morals and themes the author tried to get across: Religion, Friendship, Family, War, Faith and Death.

What attracts people to social networking sites are they are excellent places to stay in touch with friends; especially those who we do not normally see frequently. These sites also provide a forum to discuss or request a number of topics ranging from sports, languages to science and technology or even politics and news. Social networking sites (Facebook, Twitter, Myspace) can become highly addictive enough that people can turn to depend on them for confidence as well as increase personal information about others. According to Kiesbye, National Public Radios Veronica Miller discovered Becky, a MySpace cyber twin who had copied a photo of Miller from Facebook and published it-along with photos of Millers family-on the imposters site. Although Millers impersonator did not threaten or stalk her (and MySpace promptly removed Beckys site), the incident shows the potential of such sites for stalking or harassment (Kiesbye 2011). According to many surveys and studies employers surfing the web has become one of the number one reason why people are fired from work. Many are denied jobs, dismissed from work or disciplined because of comments they h ave carelessly left lying around on social networking sites. Sharing too much information on social networking sites can be problematic in two ways. First, it can reveal something about you that you rather your current or future employer or school administrators not know, and second, it can put your personal safety at risk. A potential downside of social networking sites is that they allow others to know a persons contact information, interests, habits, and whereabouts. Consequences of sharing this information can diverge from the relatively harmless but annoying such as an increase in spam to the potentially deadly such as stalking. Criminals can use information provided about a persons birthday, location, routine, hobbies, and interests to impersonate a trusted friend or convince the unsuspecting that they have the authority to access personal or financial data. Even though SNS have potential harm because of stalkers or hackers, there is a way to avoid it. Someone should never disclose private information online or through a chat. If possibl e do not send relevant information, including bank account information, your social security number, and birthday, over the Internet. Several social networking site features may increase users vulnerability to stalkers and other predators. For example, new MySpace members was asked to supply a name or nickname and information about their marital status, sexual orientation, hometown, school, religion, education, interests (e.g., music, movies, television, books, and heroes), children, or income. Although most of these questions are optional, users may automatically answer them because they are using the site to meet other people. On many sites, all these answers go public, remaining open to anyone who uses the site. Stalkers may use such information to gain access to site members. Victims also have options in civil or family courts. Distinguishing Panavision And Bensusan The law regarding jurisdiction determination was far from crystal clear even before the internet came of age, and courts are now having a difficult time reconciling the "purposeful availment" and related "effects" tests used in traditional jurisdiction analyses with the new paradigms in information transfer made possible by the internet, and in particular by the World Wide Web (WWW). These difficulties are apparent in Panavision, Int'l. L.P. v. Toeppen, 938 F. Supp 616 (C.D. Cal. 1996), and Bensusan Restaurant Corp. v. King, 937 F. Supp. 295 (S.D.N.Y. 1996). Both cases involved trademark infringement and dilution suits stemming from the alleged use of the trademark on the WWW. Each court came down differently on the jurisdiction issue, and rightly so, but neither court's analysis was very satisfying when one attempts to distinguish the two cases. In Toeppen, the defendant had formed a plan to find prominent registered trademarks which had not yet been registered as internet addresses, and register them as his own, with the expectation that he could sell them at a substantial profit to the owner of each mark should that owner desire to do business on the internet using that internet address. The court used a three-part test for specific jurisdiction, the first part of which was the "purposeful availment" test, which in turn became an "effects test" when the claim is in the nature of a tort. After deciding that the claim was tort-like, the court used the "effects test" and found that Toeppen's acts were 1) intentional, 2) aimed at California, and 3) caused foreseeable harm to the plaintiff. Beginning with Hamlet, Hamlet shows his depression and desire to die as he says, â€Å"O, that this too too sullied flesh would melt; Thaw and resolve itself into a dew! ; Or that the Everlasting had not fix’d; His canon ‘gainst self-slaughter! O God! God! † (Hamlet; 1. 2. 129-132). As Hamlet expresses these emotions, one can conclude that Hamlet is yet to overcome the fact that his father, King Hamlet, is dead. Hamlet’s sadness grows as he is not pleased with his mother, the Queen, as she is perfectly fine about Hamlet’s father’s death; in fact she marries her dead husband’s brother. These two situations have lead Hamlet to think that his suffering will only end if he switches off his life. Thus, one can guess that, through Hamlet, Shakespeare suggests that death is a medium with which one may end his misery. While Hamlet thinks about committing suicide to end his sadness, Laertes looks for ways to end the reason for his sadness. After Claudius tells Laertes that Hamlet is the one who is responsible for his father’s death, Laertes speaks, â€Å"To cut his [Hamlet] throat I’ th’ church† (Hamlet; 4. 7. 127), this expresses Laertes’s disdain for Hamlet. Laertes realizes the fact that Hamlet is the reason for his sadness, Hamlet being responsible for his father’s death. Therefore, he builds up a desire to kill Hamlet to avoid his sorrow but that grief soon turns into madness where he acts like a beast that is hungry for Hamlet’s blood. Hence, one can say that, through Laertes, Shakespeare is trying to claim that death is a solution to unhappiness. Therefore, Hamlet’s and Laertes’s responses uphold the argument, death, in the form of suicide and murder, is a solution to madness and sadness, a theme in Hamlet. Losing a loved one not only leads to grief but also builds up anger, which can be taken to the next level, avenging the culprit. Revenge may be as small as an insult, but in the play, Shakespeare shows vengeance through death. This can be first seen when the Ghost of King Hamlet asks Hamlet to take revenge for his death. In reply, Hamlet says, â€Å"O cursed spit; That ever I was born to set it right† (Hamlet; 1. 5. 189), affirming the Ghost’s plan for seeking revenge. As Hamlet gains knowledge about the death of his father and understands that Claudius is the murderer of his father, he builds up fury against Claudius.
